Terms of Service

1. Acceptance of Terms

By accessing or using Mutasib ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service. Mutasib is owned and operated by Mutasib ("we", "us").

2. Description of Service

Mutasib is a cloud-based shop management and point-of-sale (POS) platform that helps shop owners manage inventory, process sales, track revenue, generate reports, and connect with customers. The Service is offered on a subscription basis with Free, Starter ($19/month), and Pro ($19/month) plans. All prices are in US Dollars.

3. Account Registration

You must be at least 18 years old to create an account. You agree to provide accurate information, maintain account security, and accept responsibility for all activity under your account. We reserve the right to refuse service or terminate accounts at our sole discretion.

4. Subscription & Billing

Paid plans are billed monthly. By selecting a paid plan, you authorize us to charge the applicable fees. You may cancel at any time — cancellation takes effect at the end of the current billing period, and you retain access to paid features until then. For refund eligibility, see Section 4.1 below.

All payments are processed through Lemon Squeezy, which acts as the Merchant of Record for your purchases. This means Lemon Squeezy, not Mutasib, is your contracting party for payment processing, billing, sales tax/VAT, and refunds. Your payments are also subject to Lemon Squeezy's own terms of service.

4.1 Refund Policy

We offer a 14-day free trial to allow you to fully evaluate Mutasib before making a financial commitment. Because you have the opportunity to test our platform without any upfront charge, all subscription payments—including initial purchases and automatic monthly renewals—are considered final and non-refundable by Mutasib.

Cancellations

You may cancel your active subscription at any time through your account settings or by visiting lemonsqueezy.com. Cancellations will take effect at the end of your current paid billing cycle. We do not issue direct refunds or prorated credits for partial months of service or forgotten cancellations.

Exceptions and Billing Errors

If you believe you were charged due to a system error or technical billing failure, please open a support ticket via [email protected] within 7 days of the charge. These inquiries are reviewed individually, and any direct exceptions are made at our sole discretion.

Merchant of Record & Consumer Rights

Our order process is conducted by our online reseller Lemon Squeezy. Lemon Squeezy is the Merchant of Record for all our orders. Lemon Squeezy provides all customer service inquiries regarding payments, subscriptions, and returns.

If you wish to manage your subscription, dispute a charge, or request a refund based on applicable local statutory consumer protection laws, you must contact Lemon Squeezy directly by visiting lemonsqueezy.com. Any refunds approved and issued directly by Lemon Squeezy are processed in accordance with their Buyer Terms and may take 3 to 5 business days to reflect on your bank or credit card statement.

5. Acceptable Use & Prohibited Products

You agree not to: use the Service for illegal purposes, upload malware, disrupt the Service or its infrastructure, attempt unauthorized access, harass others, or resell the Service without written permission.

You represent and warrant that any content you upload or enter into the Service (including product images, descriptions, brand names, and logos) does not infringe any third party&#3s intellectual property rights. You are solely responsible for ensuring you hold the necessary rights or licenses for any content you upload.

Shop Owners agree not to display, sell, or promote the following products or content through the Mutasib platform:

1. Alcoholic beverages of any kind
2. Weapons, ammunition, and related accessories
3. Pork and pork-derived products
4. Indecent or sexually explicit images or content

Mutasib reserves the full right to:

• Refuse registration of any shop that violates this policy
• Remove any product that violates these Terms without prior notice
• Suspend or terminate any account that violates this provision
• Update this list at its sole discretion

6. Intellectual Property

The Mutasib name, logo, design, software, and code are our exclusive property. You retain ownership of your shop data, product listings, and sales records. By using the Service, you grant us a license to host and process your data solely for providing the Service.

7. Third-Party Services

The Service integrates with third-party providers including payment processors (Lemon Squeezy), email services, AI services, and cloud storage. We are not responsible for third-party availability or accuracy. Use of these services is subject to their respective terms.

8. Indemnification

You agree to indemnify, defend, and hold harmless Mutasib, its employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys&#3 fees) arising from: (a) your use of the Service; (b) any content you upload or display through the Service, including prohibited products or content that infringes intellectual property rights; (c) your violation of these Terms; or (d) your violation of any third-party right.

9. Limitation of Liability

The Service is provided "as is" without warranties of any kind. Mutasib shall not be liable for indirect, incidental, or consequential damages. Our total liability shall not exceed the amount you paid us in the twelve months preceding any claim. Nothing in this section limits our liability for gross negligence or willful misconduct, or any other liability that cannot be excluded or limited under applicable law.

10. Dispute Resolution

In the event of any dispute relating to these Terms or the Service, the parties agree to first attempt to resolve the dispute informally through direct communication within 30 days of written notice of the dispute. If the dispute is not resolved informally, both parties agree to submit it to binding arbitration rather than litigate in court, except for claims that qualify for small claims court. Each party waives the right to participate in a class action.

11. Termination

We may suspend or terminate accounts at any time. Upon termination, your data is retained for 30 days before deletion. You may request a data export before deletion by contacting support.

12. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or in-app notice. Continued use after changes constitutes acceptance.
